· Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.
· Legitimate interest:
o The legitimate interest for collecting or using personal information is to provide expert occupational health assessments and advice in the form of a report, health record or certificate of examination. The collected health data can be necessary in order to comply with legal requirements (e.g. health surveillance, medical surveillance) or to provide expert impartial occupational health advice to both the employee and the employer regarding the employee's medical fitness for work +/- adjustments. Latter may benefit the worker to maintain employment in the context of a disability and can also assist the employer to comply with relevant regulations (e.g. Equality Act 2010, etc).
· Public task – we have to collect or use your information to carry out a task laid down in law, which the law intends to be performed by an organisation such as ours. All of your data protection rights may apply, except the right to erasure and the right to portability.

How long we keep information
In line with NHS Engalnd’s Record Management Code of Practice, the minimum retention period for medical records at Sereg OccMed Ltd is 8 years, unless otherwise specified by a relevant legislation. After the minimum retention period medical records will be reviewed and if deemed no longer to be required, they will undergo confidential and secure destruction.

Duty of confidentiality
We are subject to a common law duty of confidentiality. However, there are circumstances where we will share relevant health and care information. These are where:

· we have a legal requirement (including court orders) to collect, share or use the data;
· on a case-by-case basis, the public interest to collect, share and use the data overrides the public interest served by protecting the duty of confidentiality (for example sharing information with the police to support the detection or prevention of serious crime);
